Texas Adoption Regulations

In Texas, all adoptive parents must be financially stable and at least 21 years old. In addition, Texas law provides some basic requirements that prospective adoptive parents must meet in order to be eligible to adopt. These include:

  • Be at least twenty-one (21) years of age
  • Be willing to complete an application and provide references. Prospective adoptive parents are required to provide references written by family members and non-family members alike
  • Be willing to submit to a criminal history check
  • Be willing to complete a home study. The home study will include interviews, in your home, with all members of the household
  • Be willing to attend training to learn about the issues children who have been abused or neglected might face if adopting through the Department of Family and Protective Services

Adoptive parents must undergo thorough background checks, family history checks, and home visits. This is done to ensure a safe and nurturing environment for the child to be adopted. An extensive home study course must be completed by both adoptive parents as well, and the parental rights of each living birth parent must be terminated. Prospective adoptive parents must have cleared the home study and all background checks before the adoption agency – as managing conservator of the adoptive child – will consent to the adoption. One approved, the child must live with the adoptive parents for six months before the adoption can be finalized. This final step can be waived by the court in certain cases. Termination of Parental Rights

Before you are able to adopt a child, his or her biological parents must give up all of their legal rights. Once one or both of the biological parents no longer have any legal rights to the child, you can move on to finalizing the adoption.

It is important to remember that you will be taking over as the child’s legal guardian, and the birth parents will no longer have rights to the child. You will have all legal rights, duties, and obligations to the child as if you are the natural parent. This is an enormous responsibility and one that needs careful consideration. The weight of this decision plays a large role in the steps required by the state of Texas to adopt a child.

Final Adoption Proceeding

Attorney Kutty will file all paperwork ahead of your final adoption hearing.  An ad litem attorney appointed in advance of the hearing will work to ensure the adoption is in the best interest of the child or children.
